Access to the Web-sites
We reserve the right to restrict and to prevent entirely any Subscriber’s access to the Web-sites if in our opinion that Subscriber is making inappropriate use of the Web-sites, is in breach of this Agreement or any relevant Internet protocols or is carrying out any act or failing to do any thing which jeopardises the continuance of
the Web-sites, including, without limit, "junk mailing".

Your Use of Information on the Web-sites
You may not post, publish, transmit, distribute, reproduce, redisseminate, store in any form of electronic retrieval system, incorporate in any other work (whether in electronic or hard copy) or in any way exploit any Information (other than your own) which is protected by copyright (or other intellectual property or proprietary right) save with the consent of or as expressly permitted by the copyright holder or, in the case of Information owned by us or any Associated Company other than for your own personal use, once to print or download to your hard disk up to four individual pages of such material.

Your Indemnity to the Company
You agree to indemnify us and any Associated Company against all liabilities, costs, claims or expenses which the we or any Associated Company may suffer arising out of any breach of this Agreement or any use you make of the Web-sites.

The Company’s Liability Limit
You acknowledge that in establishing the Web-sites we are under no obligation to maintain the same and give no warranties either that the Web-sites will remain uninterrupted and error free or in relation to any data loss, omissions or delays in the Information or the Web-sites. To the extent permitted by applicable law our liability for loss
or damage (other than for personal injury) shall be limited to the Subscription if due to our negligence or wilful default.
In no circumstances shall the operators or any Associated Company be liable for any indirect or consequential loss or damages (including, without limit, loss of profits) in respect of the Information on the Web-sites.
Except as set out in this Agreement and to the extent permitted by applicable law, all warranties implied by statute, trade usage or custom are hereby excluded.
You further acknowledge that the Web-sites are intended to operate along mutual lines for the collective benefit of all Subscribers and that therefore (subject to the above) in the event of your being dissatisfied with the Web-sites in any way and for any reason your remedy against us is limited to ceasing to subscribe to the Web-sites.
You agree to work with us in good faith to implement the purposes of this Agreement, but recognise that the Web-sites could not be made available under this Agreement or other similar agreements without a substantial increase in cost if we were to assume a greater degree of liability to you.

Modifications and Entire Agreement
You agree to the Company making such amendments to these terms and conditions from time to time as the Company, acting reasonably, considers appropriate or necessary in the light of the use of, or the demands being placed on, the Web-sites.
You hereby acknowledge and agree that you have not entered into this Agreement in reliance upon any warranty or representation made by the Company and that this Agreement contains the entire understanding of the parties hereto.


Data Protection
Your consent to us and any Associated Company using your name and address for the purposes of operating the Web-sites (including, without limit, making it available to other Subscribers unless you specified otherwise in your application form) and, unless you notify us otherwise in writing or by e-mail, for the purposes of sending you information on other products or services in which we consider you may be interested. You also consent to us passing your name and address to third parties for marketing purposes unless you notify us otherwise in writing or by e-mail.

Force Majeure
Neither thesharetrader.co.uk, its operators or any Associated Company shall be held liable for any loss or failure to perform any obligation hereunder due to causes beyond their or its reasonable control, including, without limitation, fire, power loss, telecommunications failure or act of any government or state.


Laws
This Agreement shall be governed by and constructed in accordance with the laws of England and Wales and subject to the non-exclusive jurisdiction of the courts thereof.
